Oahu gets state's first ban on driving with cell phones


HONOLULU — It will be illegal to use a hand-held cell phone while driving on Oahu from in July,

Honolulu Mayor Mufi Hannemann on Thursday signed into law Hawaii's first ban on the use of electronic devices by drivers.

The measure allows motorists to use handsfree mobile phones.

But it prohibits text messaging, the use of laptop computers, e-mailing and electric games while driving if the person at the wheel has a hand-held device.

Violators will be subject to fines, the state District Court will determine fines.

HTC Touch Diamond


The good:
The HTC Touch Diamond for Sprint offers better performance and supports Sprint's EV-DO Rev. A network and multimedia services. The Windows Mobile 6.1 smartphone also features the cool TouchFlo interface and has integrated Wi-Fi, Bluetooth, and GPS.

The bad:
While performance is greatly improved over the unlocked Touch Diamond, there's still some sluggishness. The virtual keyboard is cramped and may give some users problems. The Touch Diamond also doesn't offer an expansion slot.

The bottom line:
The HTC Touch Diamond for Sprint brings some nice additions and improvements over the unlocked GSM version--most notably to performance. It's best suited for first-time smartphone buyers or light users, while business customers should wait for the Touch Pro.


More cell phone users dropping landlines


The number of U.S. households opting for only cell phones has for the first time surpassed those that just have traditional landlines, in a high-tech shift accelerated by the recession.

It is the freshest that the growing appeal of wireless phones.

Twenty percent of households had only cells during the last half of 2008, according to a Centers for Disease Control and Prevention survey released Wednesday. That was an increase of nearly 3 percentage points over the first half of the year, the largest six-month increase since the government started gathering such data in 2003.

The 20 percent of homes with only cell phones compared with 17 percent with landlines but no cells.

That ratio has changed starkly in recent years: In the first six months of 2003, just 3 percent of households were wireless only, while 43 percent stuck with only landlines.

Stephen Blumberg, senior scientist at the CDC and an author of the report, attributed the growing number of cell-only households in part to a recession that has forced many families to scour their budgets for savings. People who live in homes that have only wireless service tend to be disproportionately low-income, young, renters and Hispanics.

"We do expect that with the recession, we'd see an increase in the prevalence of wireless only households, above what we might have expected had there been no recession," Blumberg said.

Six in 10 households have both landlines and cell phones. Even so, industry analysts emphasized the public's growing love affair with the versatility of cell phones, which can perform functions like receiving text messages and are also mobile.

"The end game is consumers are paying two bills for the same service," said John Fletcher, an analyst for the market research firm SNL Kagan, referring to cell and landline phones. "Which are they going to choose? They'll choose the one they can take with them in their car."

In one illustration of the impact these changes are having, Verizon Communications Inc. had 39 million landline telephone customers in March 2008 but 35 million a year later. Over the same period, its wireless customers grew from 67 million to 87 million, though 13 million of the added lines came from the firm's acquisition of Alltell Corp., according to figures provided by Verizon spokesman Bill Kula.

Another Verizon spokesman, Eric Rabe, said he wasn't sure the overall drop in landlines was directly related to the stalled economy, although he said the company has lost some landline business customers because companies are closing some of their locations.

"For somebody who's mobile and not planning to be in the same apartment for more than a year, it's very appealing to go with a cell," Rabe said.

Further underscoring the public's diminishing reliance on landline phones, the federal survey found that 15 percent of households have both landlines and cells but take few or no calls on their landlines, often because they are wired into computers. Combined with wireless only homes, that means that 35 percent of households — more than one in three — are basically reachable only on cells.

The changes are important for pollsters, who for years relied on reaching people on their landline telephones. Growing numbers of surveys now include calls to people on their cells, which is more expensive partly because federal laws prohibit pollsters from using computers to place calls to wireless phones.

About a third of people age 18 to 24 live in households with only cell phones, the federal figures showed, making them far likelier than older people to rely exclusively on cells. The same is true of four in 10 people age 25 to 29.

About three in 10 living in poverty are from wireless-only households, nearly double the proportion of those who are not poor. Also living in homes with only cell phones are one in four Hispanics, four in 10 renters and six in 10 people living with unrelated adults such as roommates or unmarried couples.

One in 50 households has no phones at all.

The latest survey involved in-person interviews with members of 12,597 households conducted from last July through December. The data is compiled by the National Health Interview Survey, conducted by the CDC.

According to a police report: Nina C. Baccala, 36, of North Providence, told the police that Lapierre invited her into his first-floor apartment at 18 Barrows St. before 2:30 a.m. and offered to get her a drink, Instead, Lapierre returned from the kitchen with a large knife.

Baccala said that Lapierre told her: “I’m not going to give you money. You’re gonna give me your money.”

Baccala told the police that Lapierre held the knife to her throat and threw her on the couch, according to the police report. Baccala sprayed Lapierre in the face with a chemical spray and fought him off when he tried to stab her, according to the police report. She fled outside and called the police.

While the police were frisking Lapierre, he told the officers that he’d just been in an altercation with a woman. The officers seized a knife with an eight-inch blade from Lapierre’s kitchen.

Lapierre was charged with April 27 a felony count of assault with intent to rob. He is being held at the Adult Correctional Institutions in lieu of $100,000 bail with surety.

Lapierre, 40, has a criminal record dating back more than 20 years. His record shows convictions for drug possession and assaults, including attacking a past girlfriend and pointing a gun at three women whom he thought were talking too long on a payphone.

Baccala, who graduated cum laude from New England School of Law, in Boston, was admitted to the Massachusetts bar in December. She is awaiting the results of the bar exam she took in Rhode Island in February. A Bryant University graduate with an MBA degree, Baccala is also listed as the president of BCN Enterprises LLC, a business that she incorporated in 2003 as a “dating service.” Her business is recorded at the secretary of state’s office as providing “assorted gifts, merchandise, personal services,” and she listed it as “telephone sales” on her 2008 application to the Rhode Island bar.

In an interview with The Journal, Baccala vehemently objected to having her name published and said that to avoid publicity she was going to tell the police she made up the attack. The publicity “will ruin my entire life,” she said.

"Upon reviewing everything in this case, the case is still proceeding forward.” Despite Baccala’s insistence that she was recanting, “We believe it happened,” Providence Police Capt. James Desmarais said late last week.

First lady calls for more family friendly policies


WASHINGTON (AP) — "A chief of staff and a personal assistant, " first lady Michelle Obama says everyone should have what she has.

Speaking Thursday in support of sick days with pay and flexible work schedules, Mrs. Obama said that, as challenging as her new life may sometimes seem, hers is a "very blessed situation, because I have what most families don't have" — support from her mother and a staff.

"Everyone should have a chief of staff and a set of personal assistants," she said at a meeting of Corporate Voices for Working Families, a nonpartisan, nonprofit organization that works to develop and promote policies to help working families.

Absent personal assistants for all, Mrs. Obama said workers should have paid sick days, schedules that give them time for their family responsibilities, such as picking up children or taking them or parents to doctors' appointments, and quality child care on the job.

Also needed is paid leave for the birth or adoption of a child, or to deal with serious illness, she said.

"These types of policies can be the key to whether a family remains economically viable or slips into financial uncertainty," she said.

Some 22 million working women don't have one paid sick day, Mrs. Obama said, meaning they lose money anytime they have to skip work because of an ill child. Current law, the Family Medical Leave Act, provides unpaid leave for birth, adoption or serious illness.

But "one income really doesn't always cut it anymore," she said.

"I personally ... know the challenges of leading a busy life at work and at home, trying to do a good job at both and always feeling like you're not quite living up to either," Mrs. Obama said. "If people here are like me, I call myself a 120 percenter. If I'm not doing any job at 120 percent, I think I'm failing. So if you're trying to do that at home and at work, you find it very difficult and stressful and frustrating."

Suggested the challenge ahead will be to help employers see that investing in family friendly policies will pay off for them as well as their workers, she praised the organization for its research.
